Copyright

Effective: [Effective date]

Invitly respects the work of photographers, musicians, artists and everyone else who creates. This page explains how to send us a copyright notice under the Digital Millennium Copyright Act, and what to do if your content was removed by mistake.

Our policy

We remove material that infringes someone's copyright when its owner, or someone acting for them, tells us about it in a notice that holds what is listed below.

Our designated agent

Send copyright notices to our designated agent:

  • Name: [Copyright agent's name]
  • Postal address: [Copyright agent's address]
  • Email: [Copyright agent's email]
  • Phone: [Copyright agent's phone]

You can also use our report page with the category "My work used without permission"; for a formal notice, include everything listed below.

Sending a notice

A notice must include:

  • your physical or electronic signature, as the owner or as someone authorised to act for the owner;
  • the copyrighted work you say was infringed;
  • the material you say infringes it, and where it is, such as the invitation's link and a description of the photo, video or sound;
  • your name, postal address, phone number and email address;
  • a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act for the owner.

A notice that leaves out one of these may not be valid. Sending a notice you know to be false can make you liable for damages.

If your content was removed

If you believe we removed your content by mistake or misidentification, you can send our designated agent a counter-notice with:

  • your physical or electronic signature;
  • the material that was removed and where it appeared before;
  • a statement, under penalty of perjury, that you believe in good faith that it was removed by mistake or misidentification;
  • your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, outside the United States, any district where Invitly may be found), and that you will accept service from the person who sent the notice.

We send a copy of the counter-notice to the person who sent the original notice. Unless they tell us within ten to fourteen business days that they have gone to court, we may put the material back where we still can.

Repeat infringers

We close the account of anyone who infringes copyright repeatedly, and we may block them from posting again.
